The pen is mightier than the sword but I’m going with the M16 over the camera.
As a long-time shooter, I have always been taught to never point a weapon, even unloaded, at something that you don’t want to shoot. But a photog with a camera? SSSSssss (sharp intake of breath).

I’m betting on the dud with the gun.
That’s a great shot. Now, I’m betting two things: one, the camera-guy said “Could you pose for a picture?” and two, the soldier’s CO said something along the lines of “I know it’s for a photo, but are you stupid?”
I think the photographer is actually slightly to the left of the guy with the gun, based on the shadows.
